Seems to me that ALL my wallpapers has just been copied by nextsegment!!

Please understand that I go through a lot of trouble to get the permission of brands and the owners of the wallpapers to publish their wallpapers on my site in order to gain sponsors for contests etc. not to mention that over 500 wallpapers from certain brands that did not have wallpapers was done by me with the permission from them.

I honestly do not think it is fair to come to my site and COPY ALL my wallpapers!!

So kindly remove your Hardware and Brands section

Their host is hostgator - contact them.

Tell them you have explicit rights for use of all those wallpapers, granted directly from the brand / trademark owners, and some of which you created yourself with permission from the brand/trademark owners - and that this website (nextsegment.com) has clearly copied them from your website without consent.

Oh and to help narrow it down with further info, they're using whatever hostgator server uses the following DNS: ns1765.hostgator.com, ns1766.hostgator.com

Hostgator also have guidelines for making a successful copyright infringement notice before sending it to them - you can find that here: http://www.hostgator.com/copyright <-- this is essential as it is a guideline which allows you to make a genuine copyright infringement notice.. It will help you :)

EDIT: You can also try send an email direct to the site admin, stating that following DMCA procedure, this is the first written notification of infringement of your site's content found here,here,here (replaced with links to areas of the site displaying said content), and that you are offering 7 days to comply with the removal of said content before further official action is taken.

This SOUNDS scary to anyone, and might be all that you need to do. And if they don't comply, then start taking official action (hosts, etc)

Yea Im thinking he isnt using a legit script either. The copyright is missing. And Andy is charging a pretty penny for removal on WSS. Just sayin, the two offenses typically go hand in hand.

I'd skip contacting the website owner. Go straight for the throat and contact hostgator. Play hardball and watch the kid panic when their host notifies them lol

lol... I used to be a copier myself but soon learned the hard way, one of the brands nearly sued me and over a 1000 was removed from my site :) Moving forward...I now understand the damage it does hence why I ASK first :)

I e-mailed the owner and he did reply with an apology which is fair enough but then he went and asked permission which I was unable to give - I hope he understands and does remove his brands section ASAP.

All I can really say is that I would have probably not bothered if it was 1 - 10 wallpapers but personally I think copying someone's entire collection is just cheeky!

If he apologised he has admitted guilt. If he does not remove them be sure to inclufe the emails in your message to hostgator and that will back up your claim 100% as he has already admitted fault.

hmm..i had a problem with nescafe one time:)) i had to remove the picture in 7 days if not they would sued me :))))

My wallpapers has been removed!! :) His "Hardware and Brands" section does still stand but it's empty. Thanks guys for the support :)

Hey guys, is it a good idea to put something about this in your sites disclaimer?

I notice some of you use a copyright policy which covers yourself against users submitting copyrighted wallpapers.

Would it be a good idea to add a disclaimer to your site about people copying your copyrighted wallpapers also?
